Proclinic S.A.U. (hereinafter, Dontalia), owner of the website www.dontalia.com (hereinafter, the “Website”), informs you that this document establishes the General Conditions for the purchasing of products.

The purpose of these General Contracting Conditions (hereinafter, “GCC”) is, on the one hand, to inform any possible buyers of the conditions and forms in which Dontalia sells and delivers the requested products and, on the other, to define the rights and obligations of the parties under the framework of the sale of products by Dontalia to the buyer. These GCC will be applied, without restriction or reservation, to all sales of products offered by Dontalia on the Website. The Website is an electronic sales platform aimed at the sale of products solely for dentistry use. The Website is accessible through the Internet at www.dontalia.com .

Consequently, the fact that the buyer places an order for products offered for sale on the Website implies that they fully and completely agree to these GCC. The buyer declares that they were aware of them prior to placing the order.

Dontalia reserves the right to amend these GCC at any time. However, the GCC applicable to the order shall be those that the buyer accepted when placing the order.

These GCC, written in English, shall be supplemented by the provisions of the General Conditions of Use of the Website, the Legal Notice, the Privacy Policy and the Cookies Law. The personal information or data provided by the user will be processed as is established in the Data Protection Policy. By using this Website, the user consents to the processing of such information and data and declares that all information or data provided are accurate and reflect the reality. The customer is obliged to update this information whenever there are any changes.
Services offered

The website www.dontalia.com provides information to its users or potential buyers on the features of the products sold by Dontalia. The Website also provides other services such as the online sale of products and the collection of payments through a secure server.

The recipients of the Website's services are the users interested in products sold by Dontalia.

Availability

The products shown on the Website will be valid as long as they remain advertised thereon and in any case while stocks last.

In the case of products not found in our warehouses, the validity of the offers presented by Dontalia shall be subject to the availability of the products. At the time of placing the order, the Website will offer the buyer information regarding the availability of the products.

In any case, in the event of the total or partial unavailability of the products after placing the order, the buyer will be informed by email, as soon as possible, of the product's unavailability and of the total or partial cancellation of their order.

If the order is cancelled due to lack of stock, the payment will be refunded if there is no available stock of any of the products. The product can be ordered when it is once again in stock.

Conclusion of the contract and orders
Prices

The sales price of the products offered on the Website, indicated in euros (€), will be the price in effect when the buyer places the order. The sales price of the products may be amended by Dontalia at any time. This amendment will be communicated to the buyer before placing the order. This price will be that applicable under the framework of distance selling.

The prices published are valid unless there is a typographical error or a promotion has ended. All orders are subject to Spanish VAT. Once the order has been confirmed, all prices will be shown with the corresponding taxes. The €10 delivery fee will be subject to a VAT rate of 21%. Any change to VAT or other applicable local taxes will be automatically reflected in the final invoice for your order.

The price does not include any shipping costs, which will be billed as a supplement to the price of the products purchased. The buyer will be informed of shipping costs before they place the order. The different shipping methods are established below in these GCC and will appear on the Website; the shipping methods may be amended by Dontalia at any time. Therefore, Dontalia recommends that buyers regularly consult the GCC appearing on the Website.

Dontalia reserves the right to amend products, promotions, commercial conditions and prices at any time and without first notifying the user and/or buyer.

Products

The buyer may select one or more products from among the different categories offered by Dontalia on the Website.

Without prejudice to the orders placed by the buyer, Dontalia may amend the range of products offered for sale on the Website at any time, especially as a result of restrictions linked to its suppliers.

In accordance with the applicable legislation, the buyer will have the option, prior to placing the order, to view the fundamental characteristics of the products they wish to purchase on Dontalia's Website.

The products will meet the requirements of current Spanish legislation. Dontalia will not accept any responsibility in the event of a breach of the legislation of a country other than Spain where the product must be delivered (e.g., the product is banned). The buyer is responsible for checking the conditions established for the importing and use of the products and services they wish to purchase by contacting the local authorities of the country where the products are to be delivered.

The product images shown on the website are provided by the relevant suppliers and are solely shown for illustrative purposes. These images do not constitute a contractual element, nor claim, and the Buyer must limit himself to the information provided on the Website in the details and characteristics of the products, which take precedence over the associated images. If you have any doubts about the reliability of the images, please contact Dontalia Customer Service before making a final purchase of the product.

The Order

The placing of an order is equivalent to accepting these General Contracting Conditions, the General Conditions of Use, the Privacy Policy, the Legal Notice and the Cookies Law, without prejudice to any specific conditions that may be agreed by the parties.

From the moment the buyer confirms their order by clicking the “PROCEED TO CHECK OUT” icon (hereinafter, “the Order”), they will be considered to have knowingly accepted the content and conditions of the order in question and, specifically, these GCC, the fact that the order implies a payment obligation for the buyer, the prices, volumes, features, quantities and delivery periods of the products offered for sale and requested by the buyer.

Once this step has been confirmed, the buyer can no longer cancel their order. The sale will be final (subject to the buyer exercising their right to return goods under the conditions set forth in these GCC). The order will be confirmed by Dontalia by sending an email to the buyer (the "order confirmation email").

Dontalia recommends that the buyer keep the emails received in relation to their order, either printed out on paper or in electronic format. The buyer is informed that emails will be sent to the email address they provided for their identification during the registration process prior to placing the order.

Moreover, Dontalia accepts no responsibility in the event of an error when entering the email address or if the order confirmation email is not received. In these cases, the sale will be final unless the order is cancelled by Dontalia, especially if products are unavailable. However, the buyer may exercise their right to return goods under the conditions set forth in these GCC.

Once the order amount has been charged, the customer can download the invoice in the customer area, in the “Invoices” section.

Buyers are reminded that purchases from the Website are only to be made by professionals in the dentistry sector. The products are not intended for personal use (or as presents for the family). Dontalia shall not be liable for negligent and/or unprofessional use of our products. In accordance with the applicable legislation, Dontalia reserves the right to refuse or cancel, for legitimate reasons, any order in which the number of products, the amount to pay (for a single order or several cumulative orders) or other elements clearly and demonstrably show that the buyer is not a dentistry professional or suggest that the products requested are not intended for dentistry or professional use or, generally, any unusual order according to the case law applicable to the circumstances.

Likewise, in certain cases, the number of products purchased may also be limited due to the contractual obligations assumed by Dontalia with our third party suppliers.

The product images shown on the website are provided by the corresponding suppliers and are added for illustrative purposes. These images do not constitute a contractual element or a claim, and the purchaser must limit himself to the information indicated on the website in the details and characteristics of the products, which shall take precedence over the images associated with them. If you have any doubts about the reliability of the images, please contact Dontalia's customer service prior to the final purchase of the product.

Finally, Dontalia reserves the right to suspend or cancel the execution and/or delivery of an order, regardless of its nature and degree of execution, in the event of the non-payment or partial payment of the amounts owed by the buyer, in the event of any payment incidents or where there is evidence of fraud, actual or attempted, in relation to the use of Dontalia's Website, including fraud committed in previous orders.

How to place an order

Purchasing dentistry material on Dontalia is very simple. You simply need to follow the steps below:

  • Register on the Website or, if you have already done so, log in with your username and password.
  • Choose the section (clinic, laboratory, orthodontics or equipment), family and sub-family.
  • View the product that interests you. Clicking on a photograph enlarges it so that you can view the product in detail. Here you can obtain a complete description with its reference number and price.
  • Choose the ones that interest you and add them to your basket. You can then choose to continue shopping or finalize the order.
  • Once the order has been finalized, you must confirm your delivery and billing details.
  • Select the payment method that is most convenient for you (Paypal or credit card).
  • You now have the chance to check the details of your order and correct any possible errors. When you have checked the order, confirm it.
  • You will receive an email confirming your order.
  • You should receive your purchase in 2-3 working days.

Credit card
  • Dontalia accepts the following credit cards: VISA, MASTERCARD and American Express and uses the Secure Payment Site, provided by BBVA.
  • The credit cards information are introduced into a secure website system and are transferred by SSL technology.
  • Dontalia takes its responsibilities for payment security very seriously and for this reason offers a Secure Payment Site, provided by BBVA. Given that the payment is at all times made directly using the BBVA secure payment system, Dontalia does not register nor record any credit card information submitted to the payment site by its customers.
Why has my credit card not been accepted?
  • The credit card may have expired. Please ensure that the expiry date given has not expired.
  • The maximum purchase limit of the credit card may have been reached. In this case please check the card's status with the issuing bank.
  • Some of the data entered may be incorrect. In this case please ensure that all data has been entered correctly.
  • Credit card password error. Please check that the Visa or Mastercard security code has been entered correctly at the time of confirming your order. If you do not know the card security code, please check with your bank.
Paypal
  • Dontalia provides its customers with the possibility of paying for orders with PAYPAL.
  • The additional cost for this service is 1,5% of the total order .
  • When choosing this payment method, the total cost of the order will be recalculated, with the additional cost mentioned above. Once this is confirmed, you will be directed to PAYPAL page.
Bank transfer
  • Dontalia also offers the possibility to pay your order with bank transfer. In this case you will have to pay the order in advanced. In order to choose this payment method, please click on the corresponding box and confirm your order.
  • In order to choose this payment method, please click on the corresponding box and confirm your order.
  • As soon as your order has been made, you will receive an e-mail with the order information and our bank details so you can transfer the amount within the first 72 hours. After this deadline, all unpaid orders will be automatically cancelled.
  • In order to speed up the process, you can send us the transfer proof to [info@dontalia.com|info@dontalia.com]. Otherwise your order will be released as soon as we have received the bank transfer.
Delivery deadlines and method

Our customers receive their orders in approximately 2 to 3 working days.

As soon as your order has been delivered to UPS, you will receive an email with a tracking number so that you can track your order at all times.

Shipping: fees and receipt

The shipping address will be freely indicated by the buyer.

Generally, €10 (Excl. VAT) will be added to all orders under €130 (Excl. VAT) for the cost of delivery by UPS.

No delivery costs will be added to orders of €130 or more (Excl. VAT).

Due to legal requirements, orders that include spray products, corrosive liquids or inflammables cannot be sent my airmail. These products must always be transported by land. For deliveries to Malta and Cyprus, which must be sent by air transport, no sprays or liquids exceeding 100 ml are allowed.

Product returns and exchanges

With our after-sales service, we try to offer a quick and efficient service to our customers in order to resolve any problems with our items or deliveries.

If you notice any damage at the time of delivery, we ask that you immediately contact us by sending an email to info@dontalia.com.

If you need to return a product, you must go to the “My account” section on the Website, where you can easily access the section “Returns”.

After checking all the details, we will send a courier to collect your package. The courier company will contact you to arrange the details of the collection.

The deadline established for returning dentistry material will be 30 days from the purchase date (the date that appears on the invoice). No returns will be accepted once 30 days have elapsed since the purchase date.

The returned product must be in its original packaging, as it was received, and inside a box that safeguards the product's individual packaging.

The return is free of charge provided that it is made within the established deadline (30 days).

We will process the refund immediately through the same payment method used to make the purchase, as soon as we receive the dentistry material.

If you receive an incorrect amount, please call our free Customer Service number and we will resolve the problem as soon as possible.

If the return is not accepted, Dontalia will inform you by telephone that the product has arrived in poor condition and it will once again be sent to the delivery address where delivery was originally requested.

*Special rules for returns:

- No item will be accepted for return if it is not received in its original packaging or appears to have been used.

- No special items that do not appear in any of Dontalia's Catalogues will be accepted for return.

Right to return

The Buyer has the right to return goods purchased through the Website www.dontalia.com, and can return the product, should they not be satisfied, within a maximum period of thirty (30) calendar days from receipt of the product.

It should be noted that there is no right to return with regard to the provision of services when their execution has already commenced.

The amount will be refunded within a period of 30 calendar days from the date on which the decision to return the goods was effectively and unequivocally communicated, provided that the goods or products subject to return have first been received.

The right to return can be exercised by notifying Dontalia of your desire to exercise this right, by sending an email to info@dontalia.com. After this notification has been received, Dontalia will inform the customer of the steps and measures that must be considered to carry out the right to return.

Right of exclusion

Dontalia reserves the right to deny or withdraw access to the portal and/or the services offered without prior notice, at its own initiative or due to a request from a third party, for those users who breach the website Terms of Use.

Dontalia will prosecute breaches of the portal’s Terms of Use, as well as any other undue use of its portal, carrying out all civil and criminal actions that may be available to it by law.

Modifications and links

Dontalia reserves the right to make any amendments it deems appropriate to its Website without prior notice, being able to change, remove or add both the content and services it provides and the way in which they are presented or located, as well as in the General Contracting Conditions determined herein.

Dontalia is not liable for the improper use of its website’s content, this being the exclusive responsibility of the person who accesses the content or uses it.

In the event that www.dontalia.com offers links or hyperlinks to other Internet sites, Dontalia, creator of the Website, will not exercise any type of control over these sites and their content, nor will it be responsible for the contents of any links belonging to another website, nor will it guarantee the technical availability, quality, reliability, accuracy, extent, truthfulness, validity or constitutionality of any material or information contained on any of these hyperlinks or other sites on the Internet. Likewise, inclusion of these external connections does not imply any association, merger or participation with the connected entities.

Applicable law and jurisdiction

The terms of use of the Website contained in these GCC, as well as the relationships between the Buyer and Dontalia, shall be governed and interpreted according to Spanish laws.

For the resolution of any conflict that may arise, the Buyer and Dontalia submit themselves expressly to Spanish jurisdiction, specifically to the authority and jurisdiction of the courts of the city of Zaragoza (Spain), expressly renouncing any other jurisdiction that may correspond to them.
